Names

In order to resolve doubts about the identity of persons if similar or common names appear in the chain, the Company customarily accepts credible affidavits. To verify that the grantor is the same person as a named vestee, the Company generally relies upon affidavits of identity.

Not Same Person Affidavit

The Company requires an affidavit or sworn statement of information in acceptable form executed by ____________ (“Party”) and another reliable person stating satisfactory information reflecting that Party is not the same person against whom the following were filed:
The Company may make additional requirements or exceptions after review of the affidavit or statement.
Comment: If judgment liens or tax liens appear against a person with a similar name to a person in the chain of title, the Company customarily accepts a credible affidavit if it recites prior and current addresses, business and social security numbers.

Same Person Affidavit

The Company requires an affidavit in acceptable form by the owner of the land and by some reliable person stating that the person named and described as _____________ in the instrument recorded _____________________, is one and the same person as the owner. At the time, the Company may make additional requirements or exceptions.
Comment: To verify that the current owner is the same as the proposed seller, the Company customarily accepts a credible affidavit of identity.

Liens Against Proposed Grantee

Name of Lender or Purchaser

The Company must receive in writing the name of anyone not referred to in this Commitment who will get an interest in the land or who will make a loan on the land. The Company may then make additional requirements or exceptions.

Identification and Marital Status

The Company requires satisfactory proof of the identity, legal age, competency and marital status (including deaths and divorces) of any individual grantor or mortgagor.
Comment: You must always verify that the proper parties executed the documents in the current closing. Verification usually should include government photo identification.
