RE: UNDERWRITING - Cyber Incident Involving loanDepot, Inc.

Dear Associates:

We have been made aware of a cyber incident involving lender loanDepot, Inc. LoanDepot has confirmed the incident on its website (https://loandepot.cyberincidentupdate.com/). Information regarding the scope, impact, and resolution has been limited, but loanDepot has indicated that updates will be posted to that web page.

Effective immediately, until the issue is resolved:

A. Payoffs to loanDepot.

For transactions involving payoff of a loan where loanDepot is the payee, servicer, or lender:

If the payoff letter from loanDepot was received by you on or before January 3, 2024, you may rely on the payoff letter and send a payoff check (via overnight delivery) as instructed in the payoff letter. Payoffs should not be made by wire, even if the instructions permit or require a wire, until the cyber incident is resolved. Review all instructions carefully.

As a reminder, as with any payoff instruction, independent verification must be made prior to disbursement.

Please continue to follow up regarding receipt of the appropriate release/satisfaction.

If you do not have a payoff letter from loanDepot received by you on or before January 3, 2024, you should not close the transaction without approval from a Stewart Title Guaranty Company underwriter.

B. New loans where loanDepot is the new lender.

For transactions where loanDepot is the new insured lender, you may close the transaction if you have received closing instructions and loan proceeds from loanDepot authorizing you to close, fund, and record the mortgage.
