RE: Ocean City, Cape May County, NJ - Riparian Claim Issue Ocean City Homes, Inc.

 Dear Associates:

By Bulletin No. NJ000103 datedMay 24, 2005, we advised you that you may not rely on a Riparian Grant recorded in Deed Book 1397 at page 95 ("Grant") with regard to certain properties located in Ocean City, Cape May County.   The Grant purports to convey the bed of former creeks in the area but the State has taken the position that it does not convey title to all of the former creek beds in the area.  The Grant shows the creeks in one location.  The claim map shows the creeks in a slightly different location.   Please note that the Deed recorded in Deed Book 1397 at page 117 is NOT a riparian grant and the list of Lots and Blocks enumerated in that deed may not be relied on to clear riparian claims. 

Accordingly, you may not rely on the Grant as conveying the former creek beds. 

Attached is a more detailed analysis by lot and block of lands that are subject to claim on the claims overlay.  Please note the attached list does not take into account riparian grants made after the Grant to Ocean City Homes, Inc. in Deed Book 1397 at page 95 (Dated 1/31/78).  Some of the claimed lots are the subject of subsequent grants which should be examined.
