Explanation:

This endorsement insures against the specified reservation(s) set out in the U.S. Patent(s) referenced in Schedule B, with certain limitations. This endorsement is not intended to be used in connection with mineral or water related reservations.

Underwriting Requirements:

1. This endorsement may only be issued on an energy project provided the survey and/or inspection and title examination do not disclose current use of the reservation.

2. If the reserved use is locatable, confirm that no existing or future Electricity Facility or Severable Improvement will encroach.

3. Reflect the applicable Schedule B exception number(s), complete the applicable fields for the definition of “Plans”, and define the intended, covered, non-mineral and non-water related reservation(s) on the line provided.

4. This endorsement is not to be used in connection with mineral or water related reservations.

5. The issuance of this endorsement requires prior STG Underwriting approval; please include a fully completed proforma of the endorsement.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.

Compliance with the underwriting guidelines contained herein in no way obligates Stewart Title Guaranty Company to issue any form or endorsement.
