Explanation:

This agreement may be used to enter into indemnities with other underwriters in your state. Section 3 has a limitation as to the maximum dollar amount on the indemnity. Section 4 has a provision for the defects that are covered by the indemnity, and those may be negotiated on a state by state basis. Section 6 has a provision for an insurer to join in the agreement, and for an existing indemnitor insurer to opt out as to a particular company.

Underwriting Requirements:

This agreement must be executed by Stewart Title Guaranty Company itself, any may not be executed by an issuing agent. Contact Stewart underwriting personnel for questions regarding this agreement.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.
