Explanation:

Provides insurance to a lender against loss in the event that a specific easement holder shall compel the removal of any portion of an improvement on the land which encroaches upon said easement. This endorsement is usually requested by a lender when an encroachment over an easement is discovered.

Underwriting Requirements:

This endorsement requires:
(a) Approval or consent of the easement holder in order to be able to offset damage from the exercise of the easement rights; or
(b) An abandonment of said easement.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.
