Explanation:

This endorsement to a Loan or Owner's Policy insures that a designated improvement is located on the land, that the improvement is known as a particular street address, and that the attached map, if any, shows the correct dimensions and location of the land according to the public records.

Endorsement 22.1 is issued with a 1992 ALTA Loan or Owner's Policy. Endorsement 22.1-06 is issued with a 2006 ALTA Loan or Owner's Policy.

Underwriting Requirements:

(1) Refer to the principal or basic improvement on the land (e.g. a residence, an apartment building, an office building), and do not mention additional structures such as pools.

(2) Do not mention other details about the improvements, such as square footage, number of floors or quality of improvement.

(3) Determine the address and improvements by review of survey, inspection, or other reasonable and objective means that clearly establishes the improvements and address. Do not rely solely on a representation by a party to the transaction, such as the borrower or seller.

(4) The map, if any, that you attach to the endorsement should be a copy of a recorded plat of the property, or other recorded map or plat that shows the correct location and dimensions of the land. Although the endorsement does not insure other information on that map or plat, such as square footage, we recommend that you delete such information.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.
