This form should not be used if a comparable ALTA version is available. If a comparable ALTA version is available, the most current version of the ALTA form available in each state should be used, unless approved by a Stewart underwriter.

SUBDIVISION MAP ACT ENDORSEMENT
(with 1992 Policy)

STEWART TITLE GUARANTY COMPANY

The Company hereby affirmatively insures the Insured against loss the insured shall sustain in the event that the (First Alternative: mortgaging and subsequent foreclosure, if it should occur) (Second Alternative: conveyance to the insured) of the parcels of land as described in Exhibit A of this Policy constitutes a violation of any State subdivision statute in effect at Date of Policy.

The liability of the Company under this Endorsement shall not be limited by Exclusion No. 1(a)(ii) and (iii) of the Exclusions from Coverage of said Policy but shall remain subject to the remaining Exclusions From Coverage, Conditions and Stipulations and Schedules.

Loss or damage as to the matters insured against by this Endorsement shall not include loss or damage sustained or incurred by reason of the refusal of any person to purchase, lease, or lend money on the estate or interest covered by this Policy.

THIS ENDORSEMENT MAY NOT BE ISSUED WITHOUT APPROVAL FROM STEWART TITLE GUARANTY UNDERWRITING PERSONNEL

The total liability of the Company under said Policy and under this and any other endorsements thereto shall not exceed, in the aggregate, the amount of liability stated on the face of said Policy, as the same may be specifically amended in dollar amount by this or any other endorsements, and the costs which the Company is obligated to pay under the Conditions and Stipulations of the Policy.

This Endorsement is made a part of said Policy and is subject to the Schedules, Conditions and Stipulations therein, except as modified by the provisions hereof.

Nothing herein contained shall be construed as extending or changing the Effective Date of the aforesaid Policy unless otherwise expressly stated.
