Explanation:

This endorsement is issued only in conjunction with the Loan policy. While some underwriters have been reluctant to afford the coverage of paragraph (b) of this endorsement (being the same language as in the Form 8.1), we have devised a different endorsement by expressly stating that we are not insuring the condition of the property and by limiting the type of environmental protection liens covered. You may issue the regular 8.1 Endorsement on residential property such as single family residences or condominiums and apartments.

Underwriting Requirements:

(1) A Senior Underwriter must approve issuance of the endorsement on commercial property.
(2) If the land is a high risk site such as a landfill or chemical plant, we will provide only the coverage of paragraph (a).
(3) We will make exception to the specific state statutes that are relevant under paragraph (b).

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.

Compliance with the underwriting guidelines contained herein in no way obligates Stewart Title Guaranty Company to issue any form or endorsement.
