CLTA Present Violation of CC&R Endorsement Guideline 100.20

Explanation:

Provides the owner or lender with insurance against loss as a result of the enforcement or attempted enforcement of a violation of the CC&Rs which is already in existence and shown in Schedule B of the policy.

Underwriting Requirements:

(1) If coverage is requested for a violation which is already in existence under only one provision of the CC&Rs and the CC&Rs contain many provisions, the CLTA 100.4 or CLTA 100.7 Endorsements should be considered rather than the CLTA 100.20 Endorsement.
(2) Under this endorsement, liability is assumed by Stewart Title Guaranty for any loss resulting from any attempt to enforce the restrictions by reversion or injunction, etc. Therefore, the endorsement may only be issued with the approval of the appropriate Stewart Title Guaranty underwriting personnel.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states.
