Explanation:

Provides the owner of the subject property insurance regarding both existing and future violations of the CC&Rs.

Underwriting Requirements:

(1) This endorsement is designed for use with either the CLTA or ALTA owner policies.
(2) All violations must be shown as exceptions in Schedule B.
(3) If no present violation exists, the form may still be used without alteration to insure against a proposed future violation.
(4) As in the CLTA 100.5, the CLTA 100.6 Endorsement may be given with the approval of the appropriate Stewart Title Guaranty underwriting personnel when it is very likely that a court would deny enforcement of particular CC&Rs with respect to present or proposed violations of the CC&Rs.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.
