Explanation:

This endorsement provides assurances to an owner or lender against loss by reason of the enforcement of a lien or encumbrance shown on the policy.

Underwriting Requirements:

(1) This endorsement is used when Stewart Title Guaranty Company is asked to insure over a recorded lien or encumbrance (i.e., deed of trust, mortgage, judgment, etc.).
(2) This endorsement may only be issued with approval of the appropriate underwriting personnel at Stewart Title Guaranty when circumstances indicate that the lien will not be enforced or a sufficient indemnity is obtained and approved.
(3) The lien must be shown on the policy and then insured over with the appropriate language.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.
