The Company hereby insures the Insured against loss or damage which the Insured shall sustain by reason of:

The failure of the lien of the Mortgage Insured herein at the date of this endorsement, to be first, prior and superior to any other liens except as to any lien shown herein or in Schedule B or any prior endorsement to the policy, or to any lien or right to for services, labor and materials furnished after (date of Sworn Contractor's Statement) and except as to any lien or right to a lien of mechanics and material suppliers who are named on the contractor's statement dated _____________, and of mechanics and suppliers claiming by, through and under them to the extent, if any, that the amounts shown in said statements as being unpaid, relate to work, labor and materials actually in place on said land on the date covered by the statement.

The liability of the Company under said Policy shall not exceed the sum of $____________________ (being the amount actually disbursed of the proceeds of the loan secured by the Mortgage Insured) and costs which the Company is obligated under the Conditions to pay, but such liability shall be increased by the sum of each subsequent disbursement made under said mortgage up to the face amount of the policy, subject ,however to any defects, liens, encumbrances, adverse claims or other matters, if any created, first appearing in the public records or attaching subsequent to the effective date hereof but prior to the effective date of a date down of this commitment covering the date of each disbursement.

The total liability of the Company under said Policy and any endorsements attached thereto shall not exceed, in the aggregate, the face amount of said Policy and costs which the Company is obligated under the provisions of said Policy to pay. This endorsement is made a part of said Policy and is subject to the exclusions, schedules, endorsements, conditions, stipulations and terms thereof, except as modified by the provisions thereof.
