RE: UNDERWRITING - Utah Department of Insurance R592-6

Dear Associates:

The Utah Department of Insurance has revised R592-6 Unfair Inducements and Marketing Practices in Obtaining Title Insurance Business. The Department of Insurance with the Utah Title and Escrow Commission determined that an update to portions of the rule was necessary. A copy of the Administrative Rule Analysis can be found at R592-6.

Material changes to the rule are:

  • A title commitment may be prepared without a charge or cancellation fee.
  • Deletion of the prohibition of joint office space with a client of a title producer.
  • Self-promotional item limit raised to $25.
  • Total cost of a business meal, a business activity, or both, per person per day, limit raised to $100.
  • Continuing Education expenditure for facility and instructor cost no more than $500.
  • Continuing Education expenditure for the cost of meals and refreshments, limit raised to $20 per anticipated person.

The rule became effective on June 7, 2024.
