Dear Associates:

We have been made aware of an issue in several counties concerning delays in obtaining information from the County Clerk’s office which has affected the timely posting of recorded documents in title plants and the ability to otherwise update title search information.

If your current search is effective through a date more than 14 days prior to the date of the policy to be issued you must contact a Stewart Title Guaranty Company Texas underwriter. If your current search is effective through a date more than 14 days prior to the date of the commitment add the following language in Sch. C:

“Currently access to [insert county name] County Public Records is limited and may not provide accurate up-to-date information. If a current up-to-date search is not available at time of closing Company will require an indemnity in a form provided by Company, related to matters that may arise from the date of the most recent available recorded information.”

If your transaction otherwise requires approval to issue overlimit or extra hazardous coverage, please include in the request for approval the effective date of your current search with a notation that an updated search may not be available. If the county clerk in the county where the property is located is not currently accepting documents for recording or if you have any questions relating to this or other bulletins, please contact a Stewart Title Guaranty Company underwriter.
