RE: UNDERWRITING - Lucas County, Ohio, Clerk of Court

Dear Associates:

We have recently become aware that the Lucas County Common Pleas Court Clerk’s office converted to a new system for searching all cases in the clerk’s office, including any pending civil suits, Judgment Liens, Domestic Relations cases, and all other matters filed in the clerk’s office. Because the accuracy of searches for all such matters filed in the clerk’s office is now questionable, the following exception must be included in commitments, updates, and policies until further notice: 

Any pending civil suits, Judgment Liens, Domestic Relations cases, and all other matters filed in the Lucas County Common Pleas Clerk’s office are currently not available. As a result, we cannot provide an accurate search of these records. This policy does not insure against any loss or damage arising out of any matters filed in the Lucas County Common Pleas Clerk’s office.

If you have access to a title plant in Lucas County, the plant may have current judgment information through the date of the attempted implementation of the new system and the above exception may need to be modified to reflect the dates of the court records you can reliably search. Please check with the plant administrator.
