RE: RATES AND/OR FORMS UPDATE - Revised Arizona Rate Manual

Dear Associates:

The Arizona Department of Insurance has approved the following form and rate revisions, which become effective September 11, 2023:

A copy of the Revised Arizona Manual of Charges and Forms for Title Insurance is available here.

A summary of the changes to the Rate Manual is included below.

  • Increased basic rate in Maricopa County by 2%. This resulted in a $25.00 increase in the basic rate.
  • Added zone 3 for Mohave County so the rate would not go up there.
  • Amended section 205 to allow for a residential refinance rate to be applied where the proceeds are used for anything other than an acquisition in a simultaneous sale or construction loan.
  • Amended section 107 to issue the policy at acquisition and reissue a new policy upon resale.
  • Amended endorsement chart to include ALTA endorsement 9.10 as a customary endorsement (denoted with an asterisk).
  • Amended endorsement chart to include 2 previously filed endorsements (STG Standard Arbitration Endorsement and General Endorsement) and 1 new endorsement (ALTA 48 – Tribal Waivers and Consents).
  • Removed 4 CLTA endorsements that are no longer in use: CLTA 100.31, 100.32, 100.35, and 100.38.
  • Revised Centralized Processing Loan and Refinance Rate (CPLR) section:
    • Tier 1: changed top limit from $300K to $250K
    • Tier 2: changed top limit from $525K to $500K

The new forms approved in this filing include the following:

  • 9237 ALTA 18.3-06 - Single Tax Parcel and ID (12-1-18)
  • 9067 ALTA 23.1 Coinsurance Multiple Policies 5-12-22
  • 9072 ALTA Short Form Residential Limited Coverage Junior Loan Policy (4-2-22)
  • 9071 ALTA Residential Limited Coverage Mortgage Modification Policy with Arbitration (4-2-22)
  • 9070 ALTA Residential Limited Coverage Junior Loan Policy with Arbitration (4-2-22)
  • 9073 ALTA Endorsement JR 1 (4-2-22)
  • 9074 ALTA Endorsement JR 2 (4-2-22)
  • 9075 ALTA 48 Tribal Waivers and Consents (4-2-22)
  • 9011 ALTA Loan Policy of Title Insurance, Schedule A, BI, BII with Arbitration (7-1-21) – This form was originally filed and approved in 2021, but it did not include a Schedule A with item #6. The version approved in this filing includes item #6 so that the option to incorporate a list of endorsements is now available.
