Dear Associates:
Missouri HB 1662, effective August 28, 2022, provides that no deed recorded on or after August 28, 2022, may contain any restrictive covenant recitals on property, real or personal, found in any deeds, plats, restrictions, covenants, or other conveyances of any type or nature that relate to the race, color, religion, or national origin of any person and any such covenants shall be void and unenforceable and shall be ignored as if the same never existed.
The 2021 ALTA commitments and policies include conditions which address discriminatory covenants, and no action is required on your part if you issue the ALTA 2021 commitment and policy forms.
HB1662 also adds an additional requirement for recording of documents: A deed must also include all grantors’ names and marital status.
