RE: RATES AND/OR FORMS UPDATE - RATES AND/OR FORMS FILING

Dear Associates:

Stewart Title Guaranty Company is filing a new amended Schedule of Charges and Forms for Title Insurance in the State of California ("STGC Manual"). This STGC Manual is pending California Department of Insurance approval, anticipated to become effective on May 16, 2022; please post as required. Attached are the links for your convenience. (Click here to view a copy of the “Redline” and the “Accepted” versions).

The following is an overview of the significant proposed changes to the STGC Manual. However, to best understand the changes and which apply to you, the STGC Manual itself should be read thoroughly and carefully in its entirety.

  1. Section 2.20 – Major Transactions – as amended, this section is now available for pricing for all non-residential transactions. This section also now includes a subsection for the issuance of Title Commitments for transactions priced under this section;
  2. New Section 3.17 – STG Direct Issuance Home Equity Loan Policy issued solely by Stewart Title Guaranty Company’s Centralized Title Services Division (CTS). This is an exclusive program available only to CTS’s lender clients in connection with certain home equity loans and home equity lines of credit transactions;
  3. Section 7 – Title Commitments – the changes to this section are corresponding changes resulting from the updates to Section 2.20 reflected above;
  4. Section 9 – Guarantees - subsections 9.7 Subdivision Guarantee, 9.12 Parcel Map Guarantee and 9.15 Condition of Title Guarantee – these subsections now provide for an increased liability amount of $10,000; and
  5. Section 10 – the CLTA 103.5 Water Rights, Surface Damage endorsement charge has been reduced only when issued in connection with an extended lenders on one-to-four family residential transactions.
