Dear Associates:
We recently became aware of lease to own transactions involving Choctaw American Insurance, Inc. (“CAII”) as a purchaser. CAII is a Section 17 corporation chartered pursuant to 25 U.S.C. §477 by the Mississippi Band of Choctaw Indians, a federally recognized Indian tribe (the “Tribe”).
Before Stewart will consider insurance on the above or similar transactions where CAII is the insured, as owner or lender, both CAII and the Tribe must provide a waiver of sovereign immunity for review by a STG Senior Underwriter. Do not issue any commitments or preliminary reports without such review. Further requirements and exceptions for insurance may be made if the waivers are accepted.
