RE: UNDERWRITING - Termination of Remote Notarization authorized under Emergency Order No. 1467 by the Governor

Dear Associates:

On April 7, 2020, Mississippi Governor Tate Reeves issued Executive Order No. 1467 (hereinafter “Order”) pursuant to the Mississippi Emergency Management Law which gives the Governor very broad powers. In the Order, the Governor modified certain parts of Mississippi’s Notary Law by allowing the assistance of audio-visual technology to facilitate the social distancing necessary to prevent the spread of COVID-19. Remote online notarization (RON/RIN) was authorized under the terms of the Order during the State of Emergency declared by the Governor.

Governor Reeves has declared that Mississippi’s State of Emergency will effectively expire as of August 15, 2021, at 11:59 P.M. CT. Under the Order, the in-person requirement for notarization was waived for the duration of the COVID-19 emergency and for fourteen (14) days thereafter. This means that the last day that remote online notarization in the form of RON or RIN may be used in Mississippi under the Order is August 29, 2021.
