RE: UNDERWRITING - Executive Order No. 244

Dear Associates:

On June 4, 2021, Governor Murphy signed Executive Order No. 244, ending the COVID-19 Public Health Emergency. Under the legislation, the majority of executive orders issued pursuant to the Public Health Emergency will expire 30 days from the date of the order.

As you may recall from our recent state bulletin, NJ2020004, Governor Murphy signed NJ Bill A3903/S2336 into law on April 14, 2020. This temporary law allowed remote notarial acts, and other acts executing and verifying certain documents, by notaries public and other authorized officials during the public health emergency and state of emergency declared by the Governor’s Executive Order 103 of 2020.

NJ2020004 has now been rescinded.

Audio visual/remote ink notarization will no longer be accepted by the counties as an option for recording documents after Executive Order No. 103 expires next month.

As a result of Executive Order No. 244, Stewart Title Guaranty Company also will no longer be able to insure title or authorize the issuance of Closing Protection Letters when the documents have been acknowledged or notarized using remote ink notarization (RIN).
