RE: UNDERWRITING - Executive Order 79

Dear Associates:

Governor Lee’s Executive order 26, which suspended the requirement for a personal appearance before a notary taking an acknowledgment, has expired.

In response to Governor Lee’s Executive Order 26, Stewart Title issued Bulletin TN2020001.

Bulletin TN2020001 outlined the requirements for using remote notarization and remote witnessing of documents, which was authorized under Order 26. This remote procedure has commonly been referred to as a RIN acknowledgement. Executive order 26 was extended numerous times, the last extension was executive order 79. This extended the suspension for an in-person appearance until April 28, 2021. The authorization was not extended past April 28.

Since the Governor's executive order has expired, the only form of remote acknowledgment authorized in Tennessee is under Tennessee’s Online Notary Public Act, commonly referred to as RON.

The procedure outlined in Bulletin TN2020001 for remote notarizations authorized by the Executive order 26 is no longer authorized. Executive order 79, which terminated the order 26 authorization, is attached
