The Indiana Supreme Court and Court of Appeals have each issued Orders (20S-CB-123 and 20A-CB-730, dated March 23, 2020, and March 25, 2020, respectively) regarding Court operations in response to Gov. Holcomb’s Executive Orders to “stay at home” during the coronavirus pandemic. The Courts’ Orders, and any updates, can be located at IN Supreme Ct.
Effective March 23, 2020, and through April 6, 2020), or upon further order of the Court (the “tolling period”), the Orders maintain essential court operations and the tolling of appellate matters during the tolling period. Specifically, case filings and appeals deadlines may be extended for an additional 15 days as follows:
1. Filings currently due on or between March 23, 2020, and April 6, 2020, will be due on April 21, 2020.
2. Filings currently due on or between April 7, 2020, and April 21, 2020, will be due fifteen (15) days after their current due date.
3. Filings due after April 21, 2020, remain due on their current due date.
In addition, the County Courts and other local courts may also extend the deadline for filing documents with the courts.
For underwriting and property search purposes, you may not rely on the expiration of a Court Rule deadline to clear title matters, such as timely service on a party or the appeals right of a lower court decision, which may occur during the tolling period and through April 21, 2020, and as may be further extended.
You should monitor the Court’s website to determine if these Orders are extended, amended, or new orders issued for your jurisdiction.
