RE: RATES AND/OR FORMS UPDATE - Effective April 13, 2020

Dear Associates:

The Georgia Office of Insurance and Safety Fire Commissioner has approved for use in Georgia on or after April 13, 2020, the below listed forms:

ALTA 3.3-06 (ZONING - COMPLETED IMPROVEMENT - NON-CONFORMING USE) This endorsement insures against loss or damage sustained by the Insured resulting from a Non-Conforming use not being allowed by the municipality or county because the Non-Conforming use violates a Zoning Ordinance; or a final decree of a court of competent jurisdiction either prohibiting the Non-Conforming use or requiring the removal or alteration of the improvement because, at the Date of Policy, the Non-Conforming use violates a Zoning Ordinance with respect to delineated matters. Certain exclusions apply. This endorsement can be issued with Owner’s or Loan policies.

ALTA 3.4-06 (ZONING - NO ZONING CLASSIFICATION) This endorsement insures against loss of damage sustained by the Insured resulting from an existing use not being allowed by the municipality or county because the use violates a Zoning Ordinance; or a final decree of a court of competent jurisdiction either prohibiting the use or requiring the removal or alteration of the Improvement because, at the Date of Policy, the use violates a Zoning Ordinance with respect to delineated matters. Certain exclusions apply. This endorsement can be issued with Owner’s or Loan policies.

ALTA 18.3-06 (SINGLE TAX PARCEL AND ID) This endorsement insures against loss or damage sustained by the Insured by reason of the land being taxed as part of a larger parcel of land or failing to constitute a separate tax parcel for real estate taxes; or any portion of the land not being assessed for real estate taxes under a tax identification number. This endorsement can be issued with Owner’s or Loan policies.

GA MODIFIED ENDORSEMENT 27-06 (USURY) This endorsement can be used when requested by the various lenders. The GA Modified Endorsement 27-06 should generally be used in all Georgia transactions when a usury endorsement is requested rather than the standard ALTA 27-06 endorsement. This endorsement is issued only in conjunction with the Loan Policy. This endorsement insures against loss by reason of invalidity or unenforceability of the lien of the insured mortgage resulting from violation of the usury laws of the state where the Land is located in effect at date of policy, however, an exception is added for any of said loss or damage as may be caused as a result of a determination that the interest rate as calculated, either directly or indirectly, is in excess of five percent (5%) per month as referenced in O.C.G.A. Section 7-4-18.

Pricing of the new forms will be determined by an Underwriter.
