Dear Associates:
We have recently been made aware of a new policy with the Mercer and Bergen County Clerk offices regarding notarization of documents outside of New Jersey. Both counties are currently rejecting documents acknowledged by a New Jersey notary in a foreign country. These counties are requiring an Apostille be attached with the document. As we have stated in a previously issued Bulletin, New Jersey notaries are permitted by statute to take acknowledgments outside of New Jersey. The New Jersey Land Title Association has contacted both counties to hopefully resolve this as soon as possible. In the meantime, it may be beneficial to direct your clients in foreign countries to have documents notarized at a U.S. Embassy or Consulate in order to avoid any delays in recording.
