RE: UNDERWRITING - Marital Status for Male Grantors on Deeds and Mortgages

Dear Associates:

Please be advised that on June 15th, the Governor of Michigan signed into law Public Act 54 of 2017 (see attached), which law provides that all written instruments presented for recording before April 6, 2017, must reflect the marital status of males conveyancing or mortgaging property. By implication, it was the intent of this legislation that the marital status of males would not be required to be reflected on deeds or mortgages for recordation after April 6, 2017.

The Act also provides that in the event a document was recorded prior to April 6, 2017, without reflecting the marital status of a male grantor, an Affidavit that complies with MCL 565.451a to 565.453 may be recorded stating the facts of the grantor’s marital status to correct the original recording.

As a result, it will no longer be necessary to reflect male (or female) marital status on deeds or mortgages to be recorded.

Please advise all appropriate personnel of the information above.
