UNDERWRITING - Release Tracking or Post Closing Lien Search Fees
Dear Associates:
The Florida Department of Financial services has taken the position that it is not permissible to charge a separate fee for tracking a release or for performing post-closing searches to confirm title status. The DFS, in its newsletter “Insurance Insights” reasoned that this service is included in “primary title services” and is considered to be part of the title premium. See Volume 2, No. 6 – August 2013 of Insurance Insights.
