RE: Withdrawn, Decertified and Archived Forms (CLTA)

Dear Associates:  

Within the last few months, the California Land Title Association Forms and Practices Committee and the Board of Governors withdrew, decertified and archived a number of forms, primarily policies and endorsements. 

A list of the policies affected is attached as Attachment I.  Some of the policies have been withdrawn from the list of filed policies with the California Department of Insurance.  These were policies that were no longer being used.  Others have been decertified and archived by the CLTA.  Most of these were policies that have been superseded by newer versions of the same policy.

A list of endorsements affected is attached as Attachment II.  Some of these endorsements were specifically designated for a specific policy, such as the ALTA Construction Loan Policy, which is one of the policies on the 'withdrawn' list, and therefore no longer needed.  The majority of the endorsements on Attachment II (154) deal with policies that have been decertified and archived.   

Policies and Endorsements that have been withdrawn are gone and not available for use - they have been withdrawn from the filing with the California Department of Insurance.  Policies and Endorsements that have been decertified and archived have been so designated by the CLTA - they have not been withdrawn from the filing with the California Department of Insurance.  It is possible that they can still be used if necessary or if required by a customer, in writing. 

Exhibit A to the CLTA Preliminary Report has been modified to reflect the absence of the withdrawn and decertified policies. 

As you are reading this Bulletin, changes to computer systems and forms data bases are being worked on.  Changes to the CLTA P & E diskette may not be made until the next release in early 2012.

Note:  Obviously some of these changes were made due to newer updated products.  For example, the ALTA Loan and Owner's Policies (06/17/06) have been around for over 5 years now, and those policies should be used instead of the ALTA Loan and Owner's Policies (10/17/92).  The CLTA/ALTA Homeowners Policy (02/03/10) should be used instead of the CLTA/ALTA Homeowners Policies (01/01/08) and (10/22/03).  The CLTA Standard Coverage Policy (1990), used as an Owner's Policy or a Lender's Policy, is still filed and available, and the '06 endorsements may be used with this policy.
