RE: Special Alert - Registered Warrants (IOU's) from State of California

Dear Associates:

The State of California recently announced that, beginning on July 2, 2009, California will be paying some of its debts by issuing IOUs (known officially as "registered warrants"). This bulletin advises you that you may not accept registered warrants as payment for any purpose relating to a closing or settlement of a transaction.

The following is a link to the California State Controller's Office Frequently Asked Questions relating to registered warrants:
http://www.sco.ca.gov/5935.html

As a reminder, all funds - whether by check (any type of check) or by wire transfer - should be deposited, fully settled and unconditionally credited to your account before closing a transaction.

If you have questions relating to this bulletin, please contact your local underwriting personnel or Stewart Legal Services.

THIS BULLETIN IS FURNISHED TO INFORM YOU OF CURRENT DEVELOPMENTS. AS A REMINDER, YOU ARE CHARGED WITH KNOWLEDGE OF THE CONTENT ON VIRTUAL UNDERWRITER  AS IT EXISTS FROM TIME TO TIME AS IT APPLIES TO YOU, AS WELL AS ANY OTHER INSTRUCTIONS. OUR UNDERWRITING AGREEMENTS DO NOT AUTHORIZE OUR ISSUING AGENTS TO ENGAGE IN SETTLEMENTS OR CLOSINGS ON BEHALF OF STEWART TITLE GUARANTY COMPANY. THIS BULLETIN IS NOT INTENDED TO DIRECT YOUR ESCROW OR SETTLEMENT PRACTICES OR TO CHANGE PROVISIONS OF APPLICABLE UNDERWRITING AGREEMENTS. CONFIDENTIAL, PROPRIETARY, OR NONPUBLIC PERSONAL INFORMATION SHOULD NEVER BE SHARED OR DISSEMINATED EXCEPT AS ALLOWED BY LAW. IF APPLICABLE STATE LAW OR REGULATION IMPOSES ADDITIONAL REQUIREMENTS, YOU SHOULD CONTINUE TO COMPLY WITH THOSE REQUIREMENTS.
