RE: UPDATE: Uniform Real Property Electronic Recording Act

Dear Associates:

Pursuant to our previous Bulletin FL2007005, Stewart Title required any agents wishing to take advantage of the Uniform Real Property Electronic Recording Act, F.S. Section 695.27, to wait until the Florida Department of State had promulgated the electronic recording standards. The Florida Department of State has now promulgated those electronic recording standards and County Clerks in the State of Florida may now electronically record documents. If you wish to avail yourself of this procedure, you should contact the County Clerks in your area to determine their specific requirements and which vendors are available to provide electronic recording services.

Please feel free to contact the underwriting department of Stewart Title in Florida should you have questions regarding these matters.

THIS BULLETIN IS FURNISHED TO INFORM YOU OF CURRENT DEVELOPMENTS. AS A REMINDER, YOU ARE CHARGED WITH KNOWLEDGE OF THE CONTENT ON VIRTUAL UNDERWRITER  AS IT EXISTS FROM TIME TO TIME AS IT APPLIES TO YOU, AS WELL AS ANY OTHER INSTRUCTIONS. OUR UNDERWRITING AGREEMENTS DO NOT AUTHORIZE OUR ISSUING AGENTS TO ENGAGE IN SETTLEMENTS OR CLOSINGS ON BEHALF OF STEWART TITLE GUARANTY COMPANY. THIS BULLETIN IS NOT INTENDED TO DIRECT YOUR ESCROW OR SETTLEMENT PRACTICES OR TO CHANGE PROVISIONS OF APPLICABLE UNDERWRITING AGREEMENTS. CONFIDENTIAL, PROPRIETARY, OR NONPUBLIC PERSONAL INFORMATION SHOULD NEVER BE SHARED OR DISSEMINATED EXCEPT AS ALLOWED BY LAW. IF APPLICABLE STATE LAW OR REGULATION IMPOSES ADDITIONAL REQUIREMENTS, YOU SHOULD CONTINUE TO COMPLY WITH THOSE REQUIREMENTS.
