RE: Town of Mamaroneck Local Law Affecting Sales, NYC ACRIS Recording Requirement

1) Section 106-49 of the Mamaroneck Town Code makes it illegal to occupy any building on real property sold after January 1, 2006 in the unincorporated area of the Town of Mamaroneck without obtaining a Discharge Compliance Certificate. The law applies to all real property regardless of use.

This law does not apply to mortgages, leases, gifts or devolution upon the death of one or
more owners.

The date of the contract does not control.

A Discharge Compliance Certificate states:

All of the connections from the real property being sold to (a) public storm sewer lines (b) sanitary lines, comply with the New York State Building Code and the
Town of Mamaroneck Code, and

There are no culverts, drains, hoses, leaders, lines, pipes or pumps that discharge liquids directly onto or directly toward a street, sidewalk or right-of-way.

The Town of Mamaroneck, Section 106-49 Town Code, requires a Discharge Compliance Certificate to be issued for all real property sales after January 1, 2006, regardless of the contract date.

A Certificate may be obtained from the Town Building Department by calling 914.381.7830.

2) ACRIS forms can not be submitted with a fax banner.

Please reprint all the forms except the original signature page. When submitting the original signature page, white out the fax banner.
