It has come to our attention that the NY Department of State website currently contains outdated information at the following URL:
http://www.dos.state.ny.us/cnsl/npforms.html
This URL deals with the revised Acknowledgment forms, but it appears that it was not updated after the statute was amended to include a form of acknowledgment for out-of-state use. There are errors in the advice on the website as a result. We have brought this to the attention of personnel at the Department of State, and have been advised that the matter will be rectified.
In the meantime, at least one of our agents has had a copy of the web page faxed to a closing, and as a result, an instrument was accepted using an incorrect acknowledgment.
