RE: New Recording Requirements Affecting Nassau County

Dear Associates:

The Nassau County Administrative Code was amended by the adoption of Local Law No. 4-1994. The amendment, which becomes effective on October 12, 1994 essentially requires that:

  1. $10.00 fee be paid to the County Clerk for each block that an instrument presented for recording and indexing (or for the satisfaction of a mortgage or cancellation of a lien) must be indexed against;

  2. A $3.00 fee be paid to the County Clerk for a computer-generated cover sheet which will be attached to and be part of an instrument or document affecting real property presented for recording, indexing or filing in Nassau County;

  3. The back of the last page of any instrument or document affecting real property contain the record and return address in the lower right hand corner. Such address must be typed or computer-generated print no more than 3 inches nor less than 1/2 inch from the bottom of the page and no more than 4 inches nor less than 1/2 inch from the right hand edge of the page;

  4. The back of the last page of any instrument or document presented for indexing or recording must contain the name, address and telephone number of the person or entity (e.g., a title company or agent) submitting the document. It must also be in type or computer-generated print at least 1/2 inch but not more than 4 inches from the lower edge of the page and at least 1/2 inch but no more than 3 inches from the left edge of the page;

  5. The section, block and lot must be typed or computer-printed in the lower left hand margin of the first page of the instrument or document, 3 inches from the bottom of the page and 1/2 inch from the left margin and no more than 4 inches from the bottom of the page;

  6. An additional $5.00 fee must be paid for any document not in compliance with the above;

  7. Any document submitted to the County Clerk for filing or recording, which is to be returned by mail after recording, must be accompanied by a self-addressed stamped envelope; and

  8. Anyone requiring copies of documents from the County Clerk must provide a self-addressed stamped envelope. Failure to comply with item 7 or 8 will result in the return of the non-recorded and non-filed instrument.

Base upon my conversation with a Deputy County Clerk in Nassau County a title insurer or abstract company, which presents a number of documents for recording at one time, can provide 1 envelope addressed to itself with the proper postage it if wants to have all documents mailed back to it. Of course, this would mean that the title insurer or agent would then have to mail the recorded instruments back to the appropriate parties. The Clerk indicated that if several documents are being returned to 1 party such as a lender, those documents could be batched together and submitted with 1 self-addressed, stamped envelope. In addition, arrangements could be made with the Clerk to pick up documents after recording for return to the title insurer or agent, which would then mail documents back to the appropriate party.

Please advise your personnel of these changes in Nassau County recording requirements immediately.
