Dear Associates:
If you have a pending title order on the captioned property, do not close unless you have a cancellation of a notice of pendency and discontinuance with prejudice, of action for specific performance of a real estate contract, entitled Davoud Arabian v. Haim Sarafzadeh.
Apparently not trusting the Nassau County Clerk to index the lis pendens on a timely basis, the plaintiff's attorney, Jacob S. Shakarchy of Bobrow Greenapple Skolnick & Shakarchy, P.C., has notified us by fax of this development. Since actual notice may be as good as record notice, we are passing this information on to you.
