RE: Reporting Notice of Potential Claims

Dear Associates:

The State of Missouri has laws that set out specific requirements and time frames for responding to claim notices. The statues require, among other things, that the underwriter send a written response to a first party claimant within 10 days of receipt of notice of a claim.

Sometimes the notice is given to the Agent instead of directly to Stewart Title Guaranty Company. In these instances, the Agent must immediately forward all notice information (including the envelope, as well as copies of all correspondence and documentation) via facsimile and/or overnight mail to:

Stewart Title Guaranty Company
National Legal Department
1980 Post Oak Blvd., Suite 710
Houston, Texas, 77056
Facsimile No. (713) 629-2200

If your Agency receives notice of a potential claim in the form of a telephone call or a verbal report, you may use the form available through the references section below to notify the NLD, preferably by sending a fax to (713) 629-2200, or by overnight delivery to the NLD at the address above.

If you have any questions regarding the foregoing, please contact Patrick Thesing, Chief Claims Counsel, in the National Legal Department at (800) 729-1900. Your cooperation is appreciated.

THIS BULLETIN IS FURNISHED TO INFORM YOU OF CURRENT DEVELOPMENTS. AS A REMINDER, YOU ARE CHARGED WITH KNOWLEDGE OF THE CONTENT ON VIRTUAL UNDERWRITER  AS IT EXISTS FROM TIME TO TIME AS IT APPLIES TO YOU, AS WELL AS ANY OTHER INSTRUCTIONS. OUR UNDERWRITING AGREEMENTS DO NOT AUTHORIZE OUR ISSUING AGENTS TO ENGAGE IN SETTLEMENTS OR CLOSINGS ON BEHALF OF STEWART TITLE GUARANTY COMPANY. THIS BULLETIN IS NOT INTENDED TO DIRECT YOUR ESCROW OR SETTLEMENT PRACTICES OR TO CHANGE PROVISIONS OF APPLICABLE UNDERWRITING AGREEMENTS. CONFIDENTIAL, PROPRIETARY, OR NONPUBLIC PERSONAL INFORMATION SHOULD NEVER BE SHARED OR DISSEMINATED EXCEPT AS ALLOWED BY LAW. IF APPLICABLE STATE LAW OR REGULATION IMPOSES ADDITIONAL REQUIREMENTS, YOU SHOULD CONTINUE TO COMPLY WITH THOSE REQUIREMENTS.
